New possibilities with the Dutch
Preemption Act
The Dutch preemption act for munici
palities (Wvg Wet voorkeursrecht ge
meenten) has recently been changed. The
field of implementation has been expan
ded because local governments needed
more instruments to acquire real estate
for realising newly planned neighbour
hoods. Often acquisition by agreement
turned out to be impossible against nor
mal prices, because private developers,
knowing the housing market was flouris
hing, also started buying land at pro
claimed building sites. In this article the
first experiences with the adapted law are discussed. At the
same time, the authors also look into the new possibilities of
this instrument in the fields of urban and rural land develop
ment. An important point ofdiscussion often is to what extent
the privileged position of a municipality is justified. But the
instrument can not force all developments: it only supports the
usual acquisition by agreement.
