Samenvatting
Juridische argumenten voor een centrale leidingregistratie
Na een zestal voorafgaande artikelen over kabel- en leidingregistra
tie in de bestaande praktijk, worden nu vooral juridische argumen
ten aangevoerd voor de totstandkoming van een centrale registra
tie. Allereerst is daar de behoefte aan een kadastrale registratie van
de rechten op de netwerken van kabels en leidingen als geheel en op
de afzonderlijke percelen grond waarin zij zijn gelegen. Deze be
hoefte is sterk aangewakkerd door recente arresten van de Hoge
Raad over het onroerende karakter van de leidingen en door de
voorgenomen privatisering van de nutsbedrijven. Daarnaast doet
zich de behoefte aan veiligheid gelden van de openbare voorzienin
gen welke door graafwerkzaamheden worden bedreigd. De auteur
pleit voor een samenwerking tussen het bestaande Kabels en Leidin
gen Informatie Centrum (KLIC) en het Kadaster om een complete
landelijke registratie van de ondergrondse infrastructuur tot stand
te brengen.

Summary
Juridical arguments for a central registration of cables and pipes
Following six previous articles about the practice of the registration
of cables and pipes, legal arguments are particularly emphasised to
establish a central registration. In the first place, there is the need
for a cadastral registration of the rights on both the networks of
cables and pipes as a whole and on the separate parcels of land in
which they are situated. This need is strongly reinforced by recent
judgements of the Dutch Supreme Court about the immovable cha
racter of underground cables and pipes, and by the planned priva
tisation of utility companies. Besides, the need for security of the pu
blic provisions is counting heavily, threatened by groundworks. The
author pleads for a cooperation between the existing Cables and
Pipes Information Centre (KLIC) and the Dutch Cadastre to accom
plish a complete central registration of the underground infra
structure.

Arguments juridiques pour I'enregistre-
ment central de conduits
Après six articles précédents concernant I'en-
registrement des cables et conduits dans la
pratique actuelle, sont invoqués actuelle-
ment des arguments juridiques pour Vin
stallation d'un enregistrement central. En
premier lieu il y ale besoin d'un enregistre
ment cadastral des droits sur le réseau en
tier des cables et conduits, ainsi que sur les
parcelles individuelles oü ils sont situés. Ce
besoin a été renforcé fortement par les arrets
de la Cour Supreme sur le caractère immobi-
lier de cables et conduits souterrains, et par
la privatisation prévue des entreprises d'uti-
lité publique. A cöté de cela le besoin de la sé-
curité des services publics se fait valoir, par
ee que ceux-ci sont menacés par des travaux
de terrassement. L'auteur plaide pour une
coopération entre le Centre d'Information
des Cables et Conduits (KLIC) et le Cadastre
afin de réaliser un enregistrement rural
complet de 1' infrastructure souterraine.
