gebruik van het recht, aan iederen belanghebbende toegekend, om
voorloopige inschrijvingen te vorderen, er van de rechtszekerheid
onder het positieve stelsel weinig zóu overblijven.
Deze voorstellingen berusten op eene eenzijdige opvatting van een
paar artikels der Real property act 1886 of South Australia, No 380,
waarin gezegd wordt: art. 219: „All contracts and other rights
arising from unregistered transactions may be enforced against such
(registered) proprietors in respect of their estate and interest therein,
in the same manner as such contracts or rights may be enforced
against proprietors in respect of land not under the provisions of
this act", en art. 191: „Any person claiming to be interested at
law or in equity, whether under an agreement or under an unregis
tered instrument, or otherwise howsoever in land may lodge a caveat."
Beschouwt men deze artikelen in verband met den overigen inhoud
dier wet, dan ontwaart men, dat Mr. Naber er eene te vérstrek
kende beteekenis aan toekent. Zoo zegt bijv. art. 69„The title
of every registered proprietor of land shall, subject to such encum
brances, liens, estates, or interests as may be notified on the original
certificate of such land, be absolute and indefeasible(volgen de
uitzonderingen); art 80: „Every certificate shallbe received
in all Courts as evidence of the particulars therein set forth."
Krachtiger nog drukt de wet van Queensland zich uit in art. 123
„No action of ejectment shall lie or be sustained against a registered
proprietor for the recovery of land under the provisions of this Act,
and except in any of the cases aforesaid the grant or certificate ot
title shall be held in every court of law or equity to be an absolute
bar and estoppal to any such action against the person named in
such grant or certificate of title as seised of or entitled to such land".
De uitwinning op grond van oudere rechten of titels is dus uit
drukkelijk uitgesloten, zoodat onder de woorden „contract", „agree
ment", „unregistered instrument" etc. in de door Mr. N. aangehaalde
artikels alleen kunnen bedoeld zijn bewijsstukken van met den eige
naar aangegane overeenkomsten of van hem verkregen rechten, of
